$117M Pork Payout: How to claim your share of a class action settlement

Consumers who purchased pork products in the United States between June 28, 2014, and June 30, 2018, may be eligible for a cash payment as part of a class action antitrust settlement totaling more than $117 million.

The lawsuit alleges that several major pork producers conspired to limit the supply of pork and artificially inflate prices. Companies named in the case include JBS USA Food Company, Clemens Food Group, Hormel Foods, Seaboard Foods, Smithfield Foods, Triumph Foods, Tyson Foods and data firm Agri Stats, Inc.

It is important to note that the court has not ruled that any of the defendants did anything wrong, and all companies deny the allegations.

What the lawsuit alleges

Plaintiffs allege the pork processors worked together to inflate and stabilize pork prices through the use of Agri Stats — a data-sharing service — along with production restraints and export manipulation.

Six of the defendants have agreed to settle: Agri Stats, Clemens, Hormel, Seaboard, Triumph and Tyson. Settlements with two other defendants — JBS and Smithfield — were reached previously, and the claims period for those settlements is now closed.

How much each company agreed to pay

Here is a breakdown of the individual settlement amounts:

• Tyson Foods: $85 million

• Clemens Food Group: $13.5 million

• Seaboard Foods: $10 million

• Hormel Foods: $4.465 million

• Triumph Foods: $4.1 million

• Agri Stats: No monetary payment — agreed to reform certain business practices

The combined total of all monetary settlements is $117.065 million.

How to file a claim

To receive a cash payment, eligible consumers must submit a valid Claim Form by Oct. 29, 2026. This is the only way to receive money from the settlements.

Consumers also have several other options:

• Opt out: Submit a written request to exclude yourself from the settlement, postmarked by Oct. 29, 2026. This preserves your right to sue Triumph, Hormel, Seaboard, Clemens and Tyson independently. Note: You cannot opt out of the Agri Stats settlement.

• Object: Submit a written objection, postmarked by Oct. 29, 2026, to tell the court why you believe any of the settlements are unfair.

• Do nothing: You will remain part of the settlements and be legally bound by them, but you will not receive a cash payment.
