BJP welcomes the Center’s ordinance on control of services in Delhi

The Bharatiya Janata party on Friday welcomed the ordinance put forth by the central government regarding the transfer, publication, surveillance and other incidental matters in the national capital.

According to the party statement, Delhi is the capital of the country, all of India has a claim on it and for quite some time the administrative dignity of Delhi has been damaged by the government of Arvind Kejriwal.

“The corruption of this government has also brought great embarrassment to Delhi and now, in the last week, the way the Arvind Kejriwal government tried to smear the Delhi administration and commit arbitrariness under these circumstances, the Bharatiya Janata Party welcomes the ordinance presented by the central government”. read an official statement from the BJP.

“Ambassadors from all the countries of the world live in Delhi and whatever administrative mishap happens here, the dignity of India is also tarnished all over the world,” the statement said.

The Union government on Friday introduced an ordinance to notify the rules to the Government of the National Capital Territory of Delhi (GNCTD) regarding “transfer of publication, surveillance and other incidental matters.”

The ordinance was introduced to amend the Delhi National Capital Territory Government Act 1991 and circumvents the SC’s ruling in the Center v Delhi case.

The Ministry of Law and Justice stated in the notice: “In view of its special status as the national capital, the parliamentary act should formulate a management scheme to balance the national and local democratic interests at stake, reflecting the aspirations of the people through the joint and collective responsibility of both the Government of India and the Government of the National Capital Territory of Delhi (hereinafter referred to as GNCTD)”.

The Center has passed an ordinance to establish the ‘National Capital Civil Services Authority’ (NCCSA) in Delhi. This comprises Delhi CM, Chief Secretary and Home Secretary of the Delhi government. They will now make recommendations to the Lieutenant Governor on the transfer and posting of ‘A’ Group officers and DANICS officers serving in the Delhi government.

“In order to give effect to the intent and purpose behind the provisions of section 239AA, a standing authority headed by the democratically elected Chief Minister of Delhi along with the Chief Secretary, GNCTD, the head of the administration representing the will of GNCTD officers and the Principal Secretary of the Home, is presented to GNCTD to make recommendations to the Lieutenant Governor regarding matters related to posting of transfers, surveillance, and other incidental matters,” the notice said.

However, in the event of a dispute between NCCSA and LG, LG’s decision “shall be final.”

Notably, this comes days after a Supreme Court constitutional tribunal, in a unanimous verdict, said the Delhi government should have control over the services, and the lieutenant governor is bound by his decision.
