SC: Sans motive, celebratory firing deaths aren’t homicide – Instances of India

NEW DELHI: SC has termed as “unlucky” observe of celebratory firing throughout marriage ceremonies, which frequently result in “disastrous penalties”.

Whereas adjudicating an attraction filed by an accused, who was convicted for homicide as his celebratory firing throughout a wedding ceremony induced loss of life of an individual, a bench of Justices Vikram Nath and S C Sharma held that an individual couldn’t be held responsible of homicide in such instances if there was no motive and prior enmity and it needs to be a case of ‘culpable murder not amounting to homicide’.

The bench quashed his conviction underneath IPC Part 302 and held him responsible of an offence underneath IPC Part 304 Half II and awarded him a sentence already undergone (eight-year jail time period).
