A court of Chief Justice DY Chandrachud and Justices PS Narasimha and JB Pardiwala assured Bano, represented by her lawyer Shobha Gupta, that the new court will be formed.
The Supreme Court has decided to set up a special chamber to hear Bikis Bano’s argument against the remission of sentences for 11 convicted in the case.
A court of Chief Justice DY Chandrachud and Justices PS Narasimha and JB Pardiwala assured Bano, represented by her lawyer Shobha Gupta, that the new court will be formed.
Gupta brought the matter up for an urgent hearing and said that a new bank should be formed.
“I will have a bank set up. We will see it tonight”, said the CJI.
Earlier, on January 24, the hearing on Bano’s petition to challenge the remission of sentence of 11 convicts in the Gujarat government gang rape case could not be held in the high court as the judges involved were hearing a matter related to passive euthanasia as part of a five-judge constitutional court.
In addition to the guilty plea challenging the release of the convicts, the gang rape survivor had also filed a separate petition seeking a review of the May 13, 2022 high court order on a guilty plea of a convict.

In its May 13, 2022 order, the trial court had asked the state government to consider early release of a convict in terms of its July 9, 1992 policy that was applicable on the date of conviction. and decide it within a period of two months.
The Gujarat government granted remission to the 11 convicts and released them on August 15 last year.
However, Bano’s review appeal against the May 13, 2022 order was dismissed by the high court in December last year.
